One of the regular bloggers updated that the Sinchew Daily dated 11th Dec (yesterday) published a small column about the winning case of the Tribunal claim of YogaZone's incident. Another one of them has sent me the above scanned news as I couldn't find it online.
I'm not so good in Chinese and hope my translation below is right, otherwise please send in your comment and correction.
It stated that a well known yoga center was closed in Sep 2008 and a number of the affected members have filed in their calims in the Tribunal lately to claim the refund of their paid membership fees from the owner of this yoga center. Majority of the cases received by Tribunal for Consmer Claimsin Kuala Lumpur this week are this Yoga Center case.
Claimants:
- Accountant (37 year-old)
Staying at Sri Petaling and she has signed up a life package on 26th Apr at RM3,500.
- Bank Staff (30 year-old)
Also staying at sri Petaling and she has signed up on 1st Jun. prepaid RM2,500.
- Planner (25 year-old)
Signed up at Kepong branch on 20th Jun at the fee of RM1,116. The package is for one year and free another 6 months.
- Engineer
This engineer signed up on 1st Oct this year and later found that the yoga center was already closed. As such, he appeal a refund of RM1,116.
(Comment: I thought by mid of Sep, a number of victims already started to file their claims to the Tribunal and the Receiver declared closure with the notice in YogaZone’s website on 25 Sep 2008. By 1st Oct, the affected outlet space in Plaza Damas and Kepong were taken over by Urban Yoga. So, wonder which outlet this engineer had signed up the package on 1st Oct…?)
- Business Woman
This business lady has signed up a “Golden Circle” package and paid RM5,888. She claimed that the yoga center was closed and unable to deliver services, as such appeal for full refund.
The defendant was absent and the above five claimants won the case with total amount of RM14,120.
The whole article never mentioned about the name of YogaZone, but we all aware that the only well known yoga center in Malaysia declared closure in Sep 2008 is YogaZone.
My concern here is although these five claimants have won the case but will they successfully get back their refund as the defendant was not even to take his responsibility to attend the court for hearing and YogaZone has already been declared closure. So, how are they going to get the refund? Would appreciate if any victim of YogaZone has successfully claimed their hard earn money could share with us here as there are still many victims out there looking for justice... THANKS!

hmm...last time i used to query on why some of my fav teachers are still with those renamed center, but now i think i can understand. Looking forward to attend their classes again.
Can i still file in to claim for the refund now? Hope it is not too late. But i wonder even if we won the case, can we realy get the refund, as i read a comment posted in mango.net's blog, November artile "Tribunal for consumer claims", saying that actually we won't be able to get the refund those we have won the case.
Appreciate anyone can share their experience here.
Since YZ is in Receivership, unlikely any refund since it will be classified as unsecured creditors. Similar class of creditors with those who did not file with the tribunal court but file under a proof of debt claim when the YZ goes into liquidation, a likely scenario. I hope I am wrong on this view.
A more likely but costly potential for refund would be to take action against the Receivers for not discharging their responsibilities in a responsible and diligent way. They did not even put up a scheme of arrangement or proposal for creditors and members' consideration. In actual fact, they did not even hold a single meeting with creditors or members. They just let YZ failed. Another area is not investigating the ownership(directly or indirectly) of urban yoga where the owner could be the petitioner for the receivership who is also a shareholder of YZ. The similar teachers and place of operations should raise a lot of suspicion. Any ex-members who are legal practitioners may wish to share their opinion and proposed potential recovery action. Another possible action would be fraud by the directors and shareholders of YZ(still soliciting membership knowing YZ is insolvent)

Yes, I have deleted few of the comments, not a lot.
The reason you didn't get to read could be:
- I was too busy and yet to have time to verify and release the comments. In addition, a lot of Chinese comments for this post which I need to take longer time to digest as not really good in reading Chinese. (SORRY for the delay).
- The comments could be rude and harsh, especially those Chinese words like to scold people "your mum", "his mum", "your mum's head", "stupid like pig" and etc. (Why want to be rude and get other perople's mothers involved in the war...). All these are always NOT allowed in my blog, so censored.
- Few are actually not rude but again all against the yogaloft's issue, about TJ, Jason Bak, the contrators, the creditors and etc. As mentioned in my previous post with the title "Stop The War in Yoga World" and all the comments of the post, we want a peaceful yoga world.
This blog is meant for the yoga chatting and discussion, NOT for any business war. Since yogaloft has refunded to all the affected members, whatever their business' issue with TJ, contractors, creditors and etc. are irrelevant anymore. I just don't want someone try to take these innocent comments as the opportunity to attack and start the war again.
I like the comment from Ex-YZ (Cheated) on "Stop The War in Yoga World" on 9th Dec @ 8:46pm as per below:
Fairly informative blog. Comments should be restricted to the followings:-
a)Yoga outlets;
b)Latest information on YZ in terms of receivership status, the court case to set aside the receivership, potential refund via the tribunal court or others;
c)Unscrupulous set-ups or new outlets so as to minimise cheating;
As consumers we should be united and have a proper forum to get rid of unscrupulous businessmen so that we can enjoy our hard earned money. Being an informed consumer will make us smarter.

In fact, there were only few rude and unethical comments been deleted.
Only very few comments were not posted because worried the war creator would again take the topic of yogaloft and their business' issue as an opportunity to attack and make a big havoc here. We want peaceful yoga world.
I still leave the link posted by the Anonymous (12 Dec @ 2:00pm) for the yogaloft's relevant article. It is fine to have information about the progress as it is a hot topic in town but don't start any war discussion here.

If not mistaken, I think you could use more than one identities here.
I'm having a full time job and currently also busy with a course training. As such, my schedule is quite tight and I wish I could have to let the blog's comments run freely like how I practised since I started it. But, the minute I remove the Moderation mode, some of the culprits come in and start to inject some poison over here. I really have no choice at the moment!
I will try to release the comments soonest I can and to remove the Moderation mode as soon as everything back in tune, so everyone can comment freely again.

See carefully "when" zen posted her comment, all of them moved on because got "cheated" by the 不愿具名的负责人,which all of us know that he's Jason Bak, I like Daniel's latest comment on yogalover's previous post.
your first doubt shall be WHY this Jason Bak dare not to reveal his name in front of the public, i.e. the newspaper.
secondly, you shall see why Daniel's comment is so convincing, yes, though Jason Bak looked like Japanese, but he's definitely without their ethic and attitude, look at his way of handling the employees at etsu office, it's unacceptable, not even any MNC's company.
As per what you mentioned, TJ may be the consultant of one of the manamgement in yogaloft, why no one admit it? because TJ is the only one that can admit it, and i believe that he's reading the blog, but not giving any comment, maybe he has had enough to be truthful and reply with his exact name in yogajess blog, ( the blog I felt sad as not as professional as yogalover, personal opinion ).
In addition, Jason Bak also deny that TJ is one of the consultant/management, hence, what's TJ status in this case? In fact, from beginning till now, TJ/ Zen and even the boss himself admitted that TJ is not in the scene, maybe TJ is just like YB Loh Gwo-Burne, to help the employees, consultants and contractors to fight for justice?!
After all, i only have one thing in mind, it's impossible that all the contractors, consultants and employees team up to ask for their payment, just not reasonable.
And also, read carefully, operating a yoga centre can costs you RM 800,000 monthly, this is too ridiculous in figure, as for the RM 128 they are charging, by getting even 5,000 members, they may not even be able to break-even, I've been to yoga loft once, for the capacity and facilities they have, no way they can carry more than 2,500 members for 8 shoplots they occupy. Jason Bak, be reasonable to the people that work for you, and that's the only way you may gain back our confidence. We are not stupid when reading the news, just imagine, WHY DO YOU NEED YOUR EMPLOYEE TO APOLOGIZE TO YOU IN ORDER TO PAY BACK HER SALARY? It shows how 'small gas' you are.

To answer you, I didn't delete any comment criticize on me as this could be good (so called negative) comment which allow me to further improve. Otherwise, I won't release the comment from "U are not GOD".
In fact, I only deleted those comments against the rules of my blog, i.e. with harsh word, attacking or insulting someone. Only lately, with additional temporary condition, i.e. those discussing yogaloft issue with "too sensitive" content or criticism as don't want anyone take it as an apportunity or excuse to start any war here again.
In fact, I would like to discuss this topic as it should be good to know about the progress as some of the yoga friends here been involved and affected previously. I didn't bar the one posted by Anonymous (13 Dec @ 4:10pm) as long it is not too sensitive or with any criticism. Just worry the war creator again take this blog as the platform or stage of their drama...

You really read every comment in my blog and analyse the whole case.
As I mentioned, it is good to discuss and know the progress as long this issue can be discussed peacefully. That's why I don't delete both the Anonymous (13 Dec @ 4:10pm) and your cooments related to yogaloft.
But one thing I would like to add on is whether whatever published in the paper is 100%... (anyway, this is ol me personal opinion)... Sorry for the doubt as I experienced that something reported in the paper was not 100% true on the real case before, slightly more than the actual case. Anyway, this was my past experience and the media could have better improvement now..
Jason Bak doesnt look anything like japanese at all lah, hes definitely pure 100% m;sian boy lah.From the videos,it is obvious HE IS NOT JAPANESE nor does he behave like one :) ( hope u will post my comment,yogalover88)
sometimes i just wonder, if jason bak able to settle all this outstanding to the respective party, no one like to be behave/ act like the insane people in front of the public, the only reason is simply you have directly/ indirectly finding an excure/reason not to pay them and this thing happened, i have no further comment on your way of handling things but just a simple advice you can chooose to take or leave it, yoga circle in malaysia is not too big, if you name is damaged, there's not easy for you to turn it around.

Yup, heard about this Yoga365. It seems another new yoga center at Kepong but I'm a bit skeptical on this as heard that it is again related to TJ. Experience told that every time relevant to TJ, it is another havoc. So, a bit in doubts...
You may find out via their blogs: yoga365.blogspot.com or lifeparkkepong.blogspot.com. All in Chinese and not yet finish reading it as can't really understand all (half banana, haha...)
Anyway, just read and wait till they setup as experience told us DON'T BE TOO HURRY! YogaZone gave us a good lesson that don't sign up long term membership, especially life package. yogaloft another good experience that don't be hurry, wait till the new yoga center really setup first. Better be "kiasu" than "sorry". Luckily yogaloft willing to refund in full but not all will do so...

Hi Yogalover, i visited the site for yoga365, it is very well written, even i am from chinese school, i can't write something that is as beautiful as the language written there. it is hard to explain in the exact word in english. it doesn't feel the same.
Sounds like a wonderful place. But not sure which part of Kepong it is located. Definitely look forward to this place, feel good place, thus far.

Since YZ crisis,I ve attended yoga at 3 different centres,the last 1 was yogaloft ( after watching jason bak on youtube,it has really put me off with joining yogaloft),sigh now im just waiting and looking for a small simple yoga studio with gd yoga instructors.Too bad ojas is too far for me.

You like it or not, I really feel disappointed with your double standard, if you ask all the comments not to mention anything about LG or TJ because it will "definitely" start a war, then you broke the rule and mentioned "someone" and also your personal feelingof being "skeptical" and predict a havoc of "somoene". It already clearly showed ho biased you are, you can choose to be biased from beginning like Joshua ( which we all can understand his situation ), but by "pretending" to be neutral gain you nothing. Don't ever think that I'm "someone" or "someone's side supporter" as I don't have the luxury time to do all these.

Don't be so disappointed first. You may still find a lot of good but smaller yoga studios within Klang Valley. Ojas is really good and you may consider to take their voucher package and travel once while.
I will have few more yoga centers need to find out more information before to update here, They are "Just Yoga Studio", "Uni Yoga Studio", "New Perfect Line" etc... I'm so sorry for the delay as busy clearing the blog and emails pertaining to the yogaloft issue earlier and busy at work lately.

Fine, no offence and thanks for your comments.
As I mentioned, I didn't censor the criticized comment about me as this is room for me to improve. I would like to apologize if my earlier comment was too offensive to you as you might be one of the loyal fans of TJ.
One thing to clarify, if I'm too bias, I won't publish the two relevant blogs' address here and told Jenny to surf for information. I'm just worry another war and to remind that better to wait till the physical center is setup first and don't be in hurry after the previous experience. Let find out more information first.
I wish everyone really take my blog rules seriously, that is no war but it seems some still cannot get me message and TJ getting very popular here. It would be a bit personal in my earlier comment but you are right that it is my feelings.
I felt upset when my YogaZone fee gone and have no place to practise at the initial stage. But I have been fair, forget about the past and TJ but look forwards. So, I continue to follow up the news of yogaloft when few kind bloggers sent me emails telling that yogaloft was relevant to TJ. I thought it was fine as long the company is backup by such a huge Japanese company, the boss is not TJ and he could just help in design or other setup. Moreover, few of the ex-YZ teachers were there and to provide me the details. Thought that just a sharing of informtion and if TJ is related, then it would be up to the members want to join as still have some members like him. Decision is on individual.
When got the news about the delay and outlet closed, I was the first immediately to update the news here and took the initiative contact yogaloft personnel for the affected members' interest, although I'm not affected at all. I was busy and worried about the affected members and only relief when got to know all have sucessfuly got the full refund.
But due to my aggressive involvement in this issue earlier, I got myself into the trouble. My blog messed up with all the nonsense comments and I have no choice to set a control. But every time I let go for free comment, attack come in again. I have to spend time spring cleaning. My yogalover88's mailbox full with emails related to yogaloft issue. Calls from yogaloft as well as they found that some of the comments in my blog affect or jeopardize their image. In fact, I'm not interested in their business and war as I'm only interested in genuine yoga centers for all the yoga lovers.
You might not read this reply as you said you won't come back to my blog. But, since you have commented here, some readers might expect an answer. So, hope I do answer you.

I have just received an email from Yoga365 that they read my blog and comment. They told that they are irrelevant to TJ and shock about my statement which would affect their image.

you seemed like always saying good thing about etsu adn yogaloft because they refunded to members, don't you care about the instructors? it seemed clearly to me that any teachers that get close to that "someone" deserve to be treated badly and will not gain your sympathy.
you feel sad because of your money burned only, that's why you dislike 'someone', is this fair? is this what the yoga world shall practice? i am not reallt deep in my practice but everything here seemed shallow to me, if you are really a yoga practitioner, learn to forgive and forget, can you and others do so? i doubt.

I do pity to the teachers as I like Zen's classes too. But what you expect me to do?
All the ex-YZ teachers and staffs were unpaid for months as well, I do really sympathy to them and the best I did was trying to help in looking job and tried to look for space and students whether could coordinate personal classes for the teachers. But all not worked. I was sad that couldn't help and I know I'm too little in this kind of big issues.
I did sent queries to yogaloft too while asking for the members' interests. How could they not pay the teachers (in fact they are embassadors, according to yogaloft). It is not fair that certain teachers being paid and some were not. Since they could be nice to refund to all members for the gesture of goodwill, then why couldn't they just pay to the embassadors who have been working so hard for them at the setup stage. Dawid was the one contacted me to have yogaloft information to be uploaded in my blog. He was also the one emailed me on all the relevant details all this while. He also contacted some ex-YZ members (known from my friends) to attend the free outdoor classes. He has put in so much effort on it, I know.
However, yogaloft told me another version of story. I'm not siding any party as I found both also got their points and both sound they are right. I'm not God nor jugde, so I'm not in the position to judge and it is beyond my or our ability... Don't want anyone being hurt anymore. So, get the case closed here as both parties have also lodged the report to the police and get into a court case. Let the right authority to investigate the case. If yogaloft really not paying them without any good reason, they should have to pay them ultimately by law. I believe the law will protect them.
Hope this is the end of all the sad stories in 2008... Let move forward to have a peaceful yoga world. "Bye bye all the yoga tragedy in 2008 and welcome peaceful & meaningful yoga life 2009!" (quoted by le). Just few more days to go entering 2009.
I do forget and forgive as the more I get angry, it will get my health infected... more cell to die, not worth it. Just wish everyone look forward for a better life. A Chinese words very good "Bu Jin Zhe Tui" (laptop having problem to input Chinese words today). It means you are leaving behind or moving backward if you stop there without moving forward.

I do read Mandarin and I have Chinese educated at my Primary standard. But didn't apply it for quite many years since my Secondary school. So, a lot of words cannot really understand or sometimes don't know how to translate or write it. As such, worry to cause misunderstanding (by using simple English I used everyday also caused misunderstanding, so worry to use Mandarin which is not so good could cause other meaning which I might not aware...)
p/s: Btw, may I know whether you are trying to highlight something to me as you written in all capital letters? (as I thought capital letter is to highlight something or scolding). Don't take it serious, I just wondering... Thanks ^_^
yes, the employees, contractors, consultants can sue etsu wellness for the outstanding payment, but when you know etsu wellness sdn bhd is only with RM2 paid-up capital, you will know how frustrated you are, simply when you win over the case, you get back RM2, Jason bak is too smart for all this game. we all in the IT line knows.

we all as the victims of yogaloft, etsu wellness case would like to inform everyone that we already moved on, we will take yoga as our hobby and passion, no more as the career. we just happily celebrating a peaceful and happy christmas and also awaiting another fruitful year ahead. for those who hate our 'brother', don't worry anymore, he doesn't even want be involved in yoga industry anymore; for those that your salary is still not paid till-date, no worries, when the case turnaround, your outstanding salary will be the first to be taken care of by our 'brother', just be a bit more patient; for those who still perceived that your package burnt because of our 'brother', you will see it through the very progressive year ahead that what will happen; for those who been taking advantage of our 'brother', be ware of your conscious and intention as he always mentions, as long as both are clear and good, god blessed.
2008 is coming to te end soon, 2009 is just around the corner, 'brother', keep on believing, believe in believe! we won't say only but with our support!

Please be kind to yogalover as she has done a marvellous job in keeping everyone updated with news. It is definitely not an easy task to manage such a blog. She has always been fair in handling the comments & even try very hard to keep the peace amongst the bloggers that make negative comments about other bloggers or issues.
Those that stand by TJ should not also blame her if she seems bias. Its only natural for the way she feels/think of TJ. Infact, she is right to feel this way. I feel the same towards this TJ too. Though I don't know him personally, all I know is that he has cheated millions of ringgit from all of us yoga practitioners. We should not also point fingers at the management team as the head of the company is responsible to make sure that the company runs well & not run into a financial crisis. & even if the company is not doing well, they shouldn't still continue to sell the membership till the last week YZ close for good.
So I truly support Yogalover's feelings. We were all part of the crisis, we lost our money, time, place of practice. It was such a pity as YZ was a truly lovely place to yoga.
Therefore, I hope all of you out there, give Yogalover a break & stop asking her to be fair. We all have our emotions. Would you still date the same guy/girl after you found out he/she cheated you of your love, innocence and money?? Would you still stand by his/her side when turbulence come? So, are you the type that would advise your friend to give him/her another try? Once bitten twice shy.

if you don't even know the person, how can you feel/think of a person's behaviour or attitude? From the medias? teachers? or employees? You can't 'feel/think' a person cheated you, unless it's the 'fact/truth'!
You are right that all human beings are biased/ favorable to what they like, if and only yogalover88 never mention that she's neutral, then we can accpet this favarotism. IF you set the rule and don't follow, then, it's meaningless.
Every company encourages team work, hence, good results come from team work, but not one man; then poor results shall be bear by the whole team also!
We are not here to fight who's right or who's fault, but on the basis and principle of being reasonable.

here's my points:
1. What if later you find out the he/she never cheated your love? ( Kindly take note that the 'receivership' is still pending to hearing for setting aside on 14th January 2009 )
2. yes, even turbulance comes, i will stand by him or her side, remember, 'love is unconditional', ( you should give other example if you want a more convincing case )

In fact, I took my fees as a lesson that to have a better financial planning in future. I didn't submit the tribunal claims as so happened I have just settled the last instalment to my bank in the month of July. I considered myself lucky as I'm not GC member and I need not to tight up any service payment anymore, lost RM1,588 is sad but considered lucky compared to others. I was busy body looking for the tribunal information, just because too many victims were so lost at that moment and looking for this information. Thinking it may help those GC members and those still servicing payments to the bank.
I admitted I was a bit too emotional when found my yoga frineds being hurt again and somebody misused my blog to attack with garbage while I was busy at work... I'm human, I have emotion too and would feel tired...
Anyway, whatever it is, it is the past. I just wish to move forward and hope the 'brother' could really fight to tell us if he is innocent and the truth to get all the victims back the justice. I wish him the best and to stand up again if he really is a victim too. But, hope no more war... If he loves yoga and is the pioneer in this country, believe he should wish everyone could continue yoga with a peaceful life too, and not keep on fighting because of YZ anymore. Believe all will support him again if he really can prove to everyone that he never con the members, teachers and staffs and get back the justice to them...

I never really was all that interested in Yoga until I had to do it as part of my P90X workout. It was a grueling 90 minute routine. But I have to say that it added so much to my core balance and strength. Now I am a Yoga believer. It can be very tough, but if you take your time and work to master each move, it can be very rewarding and will help your overall athleticism. Great post and blog!
